Article 1 – Definitions

In these General Terms and Conditions, the following definitions shall apply:

  • Withdrawal Period: The period during which the Consumer may exercise the right of withdrawal.
  • Consumer: A natural person who is not acting in the course of a profession or business and who enters into a distance contract with the Entrepreneur.
  • Continuing Contract: A distance contract concerning a series of products or services, with obligations spread over a specified period of time.
  • Right of Withdrawal: The option for the Consumer to withdraw from the distance contract within the withdrawal period.
  • Entrepreneur: The natural or legal person offering products or services to Consumers at a distance.
  • Distance Contract: A contract concluded between the Entrepreneur and the Consumer using distance communication techniques.
  • CESOP: The Central Electronic System of Payment Information established by the EU to monitor payment service providers.

Article 3 – Applicability

These General Terms and Conditions apply to every offer of the Entrepreneur and to every distance contract concluded. Prior to the conclusion of the contract, these conditions shall be made available electronically or in another durable form.

Article 4 – The Offer

All offers are non-binding. The Entrepreneur reserves the right to amend offers at any time.
The offer clearly specifies the total costs, including shipping charges, customs duties, and any additional fees charged by postal or courier services.

Article 5 – The Contract

The contract is concluded once the Consumer accepts the offer and complies with the specified conditions. The Entrepreneur shall promptly confirm acceptance by email.

Article 6 – Right of Withdrawal

The Consumer has the right to withdraw from the contract within 14 days after receipt of the product, without obligation to provide a reason.
Return shipping costs are borne by the Consumer when exercising the right of withdrawal.

Article 7 – Costs in Case of Withdrawal

The Entrepreneur shall refund all payments within 14 days after withdrawal, provided that the product is returned in its original condition.

Article 8 – Customs and VAT Regulations

The Customer is solely responsible for fulfilling all legal obligations related to the import of goods into the country of delivery, including the payment of import duties, taxes, and customs clearance fees.
The Entrepreneur does not act as the official importer of the goods shipped to the Customer.
The Customer must comply with all local laws and regulations concerning the import and use of purchased products.
Any additional customs-related charges, including administrative fees imposed by postal or courier services, are the sole responsibility of the Customer.
The Entrepreneur provides the necessary shipping documentation but does not guarantee that the goods will meet local import regulations. Customers are advised to verify import requirements before placing an order.

Article 9 – CESOP Compliance

As of 2024, payment service providers will register transaction data in CESOP (Central Electronic System of Payment Information) in accordance with EU regulations. The Entrepreneur complies with these rules, which may affect the monitoring and reporting of payments.

Article 10 – Compliance and Warranty

The Entrepreneur warrants that products comply with the contract and with statutory requirements.
Complaints regarding defects must be submitted in writing within 14 days.
Products must be returned in their original packaging and in good condition.

Article 11 – Delivery

Orders shall be delivered within 30 days, unless otherwise agreed.
In case of delays, the Entrepreneur shall inform the Consumer within 14 days after the order date.
Orders are shipped under conditions that designate the Customer as the recipient and responsible party for all import procedures.
The Entrepreneur ensures that products are shipped in compliance with international shipping standards but accepts no liability for delays or issues related to customs clearance.
Any failure by the Customer to fulfill import obligations does not constitute grounds for cancellation or refund of the order.

Article 12 – Complaints Handling

Complaints must be submitted in writing within 7 days after discovery of the issue.
The Entrepreneur shall respond to complaints within 14 days. If more time is required, the Entrepreneur will provide an estimated resolution timeframe.

Article 13 – Disputes

These General Terms and Conditions are governed by Dutch law. Disputes shall preferably be settled amicably. If necessary, disputes shall be submitted to the competent courts of the Netherlands.
